(Aircraft which shall not be used for air navigation)
Article 41-(2). The same type of aircraft specified in Ordinances of the Ministry of Transport under the proviso of Article 20.-(3) paragraph 3 shall be an aircraft which is included under any of the following subparagraphs.
(1)Aircraft which has not received noise certification under Article 20 paragraph 1 subsequent to 31 March, 1995.
(2)Aircraft with a maximum take-off weight of more than 34,000 kg.

 

Article 41-(3). The date specified in Ordinances of the Ministry of Transport under the proviso of Article 20-(3) shall be April 1st, 1995.

 

Article 41-(4). Aircraft specified in Ordinances of the Ministry of Transport under Article 20-(4) paragraph 2, shall be aircraft which comes under any of the following subparagraphs.
(1)Aircraft which do not comply with the standards under Article 36.
(2)Aircraft with a maximum take-off weight of more than 34,000 kg.
(3)Aircraft for which over 25 years has passed, counting from the date when a foreign state issued an original certification with regard to airworthiness certification under Article 10 paragraph 1 of the Law or airworthiness of the aircraft.
(4)Aircraft which is not classified as wide-bodied aircraft.
(5)Aircraft equipped with engines for which the ratio of air passing through the engine without being taken into combustion chamber to air being taken into combustion chamber (hereinafter referred to as “bypass ratio”) by mass per unit time, shall be less than two.

 

Note:
The above Article 41-(4) shall be revised and enforced effective April 1st, 2002. “An aircraft which comes under any of the following subparagraphs” shall be revised to “An aircraft which is not comply with the standards under Article 36 and the maximum take-off weight shall be more than 34,000 kg” and paragraphs of the said Article shall be deleted.

 

(Inspection for Repair and Alteration related to Noise)
Article 41-(5). Repair or alteration which may affect the noise level of aircraft defined in Ordinances of the Ministry of Transport tinder Article 20-(5) paragraph 1 are as follows;
(1)Change of nacelle shape and repair or alteration which results in a major change of aircraft shape.
(2)Repair of alteration which results in a change of the engine or its parts (limited to noise-absorbent materials) which affect the noise level of aircraft.
